Varsity Stack is not a medical device and does not provide medical advice.

The App does not diagnose, treat, cure, or prevent any disease
Recommendations are general wellness insights, not prescriptions

5. AI-Generated Content
Some features of Varsity Stack may use artificial intelligence.
You acknowledge that:

6. Anti-Doping & Compliance Disclaimer
Varsity Stack may reference third-party certifications (ex: NSF Certified for Sport®, Informed Sport®), but:
We do not guarantee compliance with NCAA, WADA, USADA, or other governing bodies
Manufacturing variability and contamination risk always exist
You are solely responsible for verifying compliance with your sport’s rules
7. Subscriptions & Payments
a. Subscription Access
Varsity Stack may offer free and paid subscription tiers that provide access to additional features, insights, or tools.
Subscription features, pricing, and availability will be clearly disclosed within the App before purchase.
b. Billing & Payment Processing
All subscription payments are processed through the Apple App Store or other authorized platform providers.
Varsity Stack does not collect or store your payment information.
Billing, taxes, and transaction processing are governed by the terms of the platform provider.
c. Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
The renewal charge will be applied within 24 hours prior to the end of the current period at the then-current subscription rate.
You authorize the platform provider to charge your payment method for renewal unless canceled.
d. Managing or Canceling Subscriptions
You may manage or cancel your subscription at any time through your device’s account settings (for example: Apple ID → Subscriptions).
Deleting the App does not cancel your subscription.
e. Refunds
All refund requests are handled by the platform provider (ex: Apple App Store) and are subject to their refund policies.
Varsity Stack does not issue refunds directly.
f. Changes to Pricing or Features
Varsity Stack reserves the right to:
Modify subscription pricing
Change features included in subscription tiers
Introduce new paid or free offerings

8. Affiliate Disclosure

9. Accounts & App Access
Varsity Stack may support guest accounts and future registered accounts.
You agree to:

Keep your device secure
Understand that deleting the App may remove locally stored data
Varsity Stack is not responsible for data loss due to device changes or deletion.
10. Intellectual Property
All content, software, designs, logos, and branding are owned by Varsity Stack or its licensors.
You may not:
Copy, modify, or distribute the App or its content
Reverse engineer or attempt to extract source code
Use Varsity Stack branding without written permission
11. Prohibited Use
You agree not to:
Use the App for illegal purposes
Misuse or abuse the Services
Attempt to bypass security or safeguards
Scrape, resell, or redistribute content
Impersonate others or submit false information
12. Termination
Varsity Stack may suspend or terminate access if:
These Terms are violated
The App is misused
Continued access poses legal, security, or compliance risk
13. Disclaimer of Warranties
Varsity Stack is provided “as is” and “as available.”
We make no warranties regarding:
Accuracy or reliability of content
Availability or uninterrupted service
Fitness for a particular purpose
14. Limitation of Liability
To the fullest extent permitted by law, Varsity Stack LLC and its officers, members, affiliates, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, personal injury, health-related outcomes, or athletic performance results arising from or related to your use of the App.

You agree to indemnify and hold harmless Varsity Stack from claims arising from:
Your use of the App
Violation of these Terms

16. Privacy
Your use of Varsity Stack is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
17. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
18. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in the State of South Carolina, except that either party may bring an individual claim in small claims court where eligible.
You agree to waive any right to participate in class actions, class-wide arbitration, or jury trials.
