Terms of Use
Last updated: October 11, 2026
These Terms of Use (“Terms”) govern your access to and use of the Varsity Stack mobile application, website, software, and related services, including the Personal Experience and any Team Experience made available through a school, athletic program, team, or other institution (collectively, the “Services”). The Services are provided by Varsity Stack LLC (“Varsity Stack,” “we,” “us,” or “our”).
Please read these Terms carefully. By creating an account, accessing the Services, joining a team, or using the Services as a member of an Institution’s staff, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
If you use the Services on behalf of a school, athletic program, team, or other institution, you represent that you are authorized to do so. These Terms apply to you individually and, to the extent no separate written agreement with Varsity Stack governs the subject, to that institution.
IMPORTANT: SECTION 28 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS-ACTION WAIVER, WHICH YOU MAY OPT OUT OF WITHIN 30 DAYS. SECTIONS 4(g), 6, 7, 9, 12, 24, 25, AND 26 CONTAIN DISCLAIMERS, AN ASSUMPTION OF RISK, LIMITS ON VARSITY STACK’S LIABILITY, AND A RELEASE. PLEASE READ THEM.
1. Eligibility and Acceptance
You may use the Services only if:
- you are at least 13 years old;
- you have the legal capacity to enter into these Terms;
- you are not prohibited from using the Services under applicable law; and
- you comply with these Terms and all applicable laws, rules, and regulations.
The Services are not directed to children under 13, and children under 13 may not create an account or use the Services. If you are between 13 and 17 years old, you may use the Services only with the permission and supervision of a parent or legal guardian where required by law. A Team Experience account is available only to users who are at least 18 years old.
If you are a parent or legal guardian who permits a minor to use the Services, you agree to supervise the minor’s use and, to the extent permitted by law, accept these Terms on your own behalf and on behalf of the minor. You are responsible for the minor’s activity through the Services. A school, team, coach, dietitian, or other institution inviting a minor to use Varsity Stack does not replace legally required parental or guardian permission.
2. The Varsity Stack Services
Varsity Stack provides educational and organizational tools that may help athletes:
- find supplement products certified by third-party programs such as NSF Certified for Sport®, the INFORMED programmes including Informed Sport®, and BSCG;
- receive personalized, educational supplement recommendations based on information they provide;
- build and organize a personal supplement stack, including dose and timing;
- track daily supplement intake, streaks, and reminders;
- identify supplement products by scanning a barcode or a product label; and
- participate in a team or institutional supplement-management program when offered.
Available features may differ based on your device, location, age, institution, platform, and version of the Services. We may add, remove, modify, suspend, or discontinue features. We do not guarantee that any particular feature, product database, certification source, or Team Experience will remain available. Features present in an earlier version of the Services may be discontinued; discontinuation of a feature does not entitle you to compensation.
3. The Services Are Free
The Varsity Stack athlete application is provided free of charge. There is no subscription, paid tier, trial that converts to a charge, in-app purchase, or other consumer payment, and Varsity Stack does not collect payment information from athletes or process consumer payments through any platform.
A school, athletic department, or other institution may enter into a separate written agreement with Varsity Stack covering a Team Experience. Any fees under that agreement are between Varsity Stack and the institution and are governed by that agreement, not by these Terms.
Varsity Stack may introduce a paid feature in the future. If we do, we will disclose the price, billing period, included features, and renewal terms before any purchase, and no charge will apply to you without your affirmative agreement at that time.
4. Personal Experience and Team Experience
a. Personal Experience
The Personal Experience is the athlete-controlled portion of Varsity Stack. It includes your personal supplement stack, product scanning, daily tracking and streaks, reminders, and personalized supplement recommendations. It does not include an AI chat assistant, an insights or analytics dashboard, wearable or health-platform integration, or laboratory and blood-work entry; those features were discontinued and removed from the Services.
b. Team Experience
A Team Experience may be offered through a school, athletic department, team, sports organization, or other institution (“Institution”). You may join by entering an invitation code, using an institutional account or single sign-on system, accepting an invitation, or otherwise affirmatively choosing to participate.
Before joining, Varsity Stack will provide a Team Participation and Data-Sharing Notice identifying the information the Institution may access, the authorized roles, the purpose of sharing, and how to stop future sharing. By joining a Team Experience, you authorize Varsity Stack to share only the information identified in the applicable Team Participation and Data-Sharing Notice.
Joining a team does not authorize the Institution to access your:
- separate personal account, including your personal supplement stack, personal scan history, and personal recommendations;
- medical information, diagnoses, medications, or clinical records;
- injury information;
- connected-device, wearable, or health-platform data of any kind; or
- laboratory or blood-work values.
Several of the categories above do not exist anywhere in the Services. The remainder are unavailable to the Institution unless a future feature expressly supports the disclosure, Varsity Stack has implemented the required legal and security controls, and you receive any notice or consent required by law.
Certain team features are controlled by settings your Institution manages. Adherence sharing and staff notes are on for a new team, and the Institution can turn them off. Weekly check-ins, a team leaderboard, ingredient visibility, container and lot records, and label scanning are off by default for a new team, and stay off until the Institution turns them on. The app shows you the live setting for your own team.
c. Personal and Team Accounts Are Separate
A personal account and a team account are separate accounts with separate credentials, held in separate systems. Signing in to one does not sign you in to the other, and neither account can read the other’s information.
Because of this, deleting one account does not delete the other. If you hold both, you must delete both. Each deletion confirms which account it covered.
d. Team Decisions
An Institution may review products, manage a team inventory, assign structured approval statuses, remove members, or restrict access to its Team Experience. A team review or approval status:
- is not medical clearance;
- is not a prescription;
- is not a guarantee that a product is safe;
- is not a guarantee of anti-doping compliance;
- does not determine athletic eligibility; and
- does not replace review by a physician, registered dietitian, athletic trainer, pharmacist, compliance officer, or other qualified professional.
Varsity Stack is not responsible for employment, scholarship, roster, playing-time, disciplinary, eligibility, medical, or other decisions made by an Institution.
e. Leaving a Team
You may leave a Team Experience using available account controls or by contacting us. Leaving a team stops future sharing through the Team Experience and removes your team stack and the recommendations, reminders, and notes staff created for you from the team system. Container and lot records are kept, to help the team’s own lot tracing, until your team account is deleted or the team’s data is purged. Leaving does not necessarily delete information already received or lawfully retained by the Institution, and it does not delete your team account or any separate personal account.
f. Institutional Agreements
An Institution may have a separate services agreement, data-processing agreement, business associate agreement, or other written agreement with Varsity Stack. If an institutional agreement conflicts with these Terms regarding the Institution’s obligations or Varsity Stack’s processing on the Institution’s behalf, the institutional agreement will control for that limited purpose. These Terms continue to govern your individual use of the Services.
g. Institution and Staff Responsibilities
This subsection applies to an Institution and to each person who uses the Services on its behalf, such as a dietitian, athletic trainer, administrator, or other staff member (“Staff”). The Team Experience is a record-keeping and reference tool. It does not supervise an Institution’s supplement program, and it does not replace the Institution’s professional judgment, policies, or legal duties. As between Varsity Stack and the Institution, the Institution is solely responsible for:
- every decision to approve, reject, recommend, purchase, stock, hand out, or withdraw a product, and every dose, timing, instruction, note, task, or reminder its Staff create;
- independently verifying, at the time of each decision and against the certifier’s own current listing, that the exact product, flavor, size, and lot is certified, and re-verifying over time, because a certification can lapse or be withdrawn after a product was approved or stocked;
- the accuracy and completeness of everything its Staff enter, scan, or confirm, including product identity, lot numbers, expiry dates, quantities, and which athlete received which container;
- monitoring manufacturer, regulator, and certifier recalls, safety alerts, and withdrawals, running any lot search, and notifying and following up with affected athletes;
- the qualifications, licensure, training, supervision, and conduct of its Staff, deciding who may access the Team Experience, and promptly removing anyone who should no longer have access;
- the settings it turns on or off, every notice, consent, and authorization that the law requires before it collects, views, or uses athlete information, and confirming that each person it invites to a Team Experience is at least 18 years old;
- complying with the laws, sport-governing rules, and institutional policies that apply to it, and keeping in its own systems any official record it is required to keep; and
- its own use, retention, and onward disclosure of information it obtains through the Services.
Varsity Stack does not review, verify, or approve Staff decisions or entries and is not responsible for them. To the fullest extent permitted by the law that applies to the Institution, and except where a separate written agreement between the Institution and Varsity Stack provides otherwise, the Institution bears responsibility for claims arising from the matters listed above. A Staff member acting within their role is not personally responsible for the Institution’s obligations under this subsection. An athlete’s question or complaint about a team decision should be directed to the Institution.
5. No Medical Advice or Emergency Services
Varsity Stack is not a healthcare provider, medical practice, pharmacy, laboratory, emergency service, or medical device. The Services do not provide medical advice, diagnosis, treatment, prescriptions, clinical monitoring, or emergency assistance.
Information provided through the Services is intended for general educational, informational, and organizational purposes only. It should not be used as a substitute for professional medical judgment. Using the Services does not create a physician-patient, dietitian-client, or other professional relationship between you and Varsity Stack. Always consult an appropriately licensed physician, registered dietitian, pharmacist, athletic trainer, or other qualified professional before:
- beginning, stopping, or changing a supplement;
- combining supplements or medications;
- treating an injury, illness, deficiency, or medical condition;
- changing your diet or hydration practices; or
- making a decision that may affect your health, safety, or athletic eligibility.
Do not use Varsity Stack in an emergency. If you believe you may be experiencing a medical emergency, call 911 or your applicable local emergency number immediately.
6. No Medical, Health, or Performance Guarantees
Varsity Stack does not guarantee:
- that any supplement is safe, effective, appropriate, or necessary;
- any athletic or academic performance result;
- injury prevention or recovery;
- improved sleep, recovery, strength, endurance, mood, or wellness;
- correction of a nutritional deficiency;
- weight gain or weight loss;
- continued product certification;
- compliance with sport-governing rules; or
- any specific medical, physiological, or performance outcome.
Results vary by individual. Examples, trends, recommendations, testimonials, and illustrations are not guarantees of future outcomes.
Statements about dietary supplements in the Services have not been evaluated by the U.S. Food and Drug Administration. Dietary supplements are not intended to diagnose, treat, cure, or prevent any disease.
Assumption of risk. Dietary supplements carry inherent risks, including allergic reactions, side effects, interactions with medications or other supplements, contamination, mislabeling, and a positive anti-doping test. Those risks exist for certified products too. You decide whether to buy or take any supplement. To the fullest extent permitted by law, you voluntarily assume the risks of that decision, whether or not the product was displayed, recommended, scanned, shown as certified, stocked, handed to you, or approved through the Services.
7. AI-Assisted Recommendations and Label Extraction
The athlete app generates a personalized supplement stack from the information you provide. To do this, we send your profile answers, your self-reported wellness answers, your current stack and a summary of your recent tracking, and a list of candidate supplements to an AI provider, which selects several supplements and writes a short explanation for each. This is described in the Privacy Policy.
Both the Personal and the Team Experience also use OpenAI to identify a product from a privacy-minimized photograph of supplement packaging, as described in Section 8. That request includes only the processed packaging image and fixed instructions, and the same image is also submitted, on its own, to OpenAI’s moderation service so that unsuitable images can be screened out. It does not include an athlete name, user or account identifier, school, team affiliation, notes, recommendations, health information, or other profile context. There is no AI chat assistant and no stored AI conversation. In the Team Experience the label scan is limited to product identity, runs on its own separate provider project and credentials, and is controlled by the Institution, off by default for a new team; no other team feature makes an AI request of any kind.
You acknowledge that AI-generated recommendations and AI-extracted label fields may:
- contain errors;
- omit relevant information;
- misunderstand your inputs;
- rely on incomplete or outdated information;
- generate inconsistent results; or
- be inappropriate for your individual circumstances.
Recommendations and their explanations are educational. They are generated from the limited answers you give, and they are not a check against your allergies, medications, medical conditions, pregnancy, or the prohibited list that applies to your sport. They are not medical advice, prescriptions, anti-doping determinations, or professional recommendations. AI-extracted label fields are a draft for you to review, not a product-certification, safety, banned-substance, or approval decision. You must independently evaluate AI output and consult a qualified professional when appropriate. You may not rely on it as the sole basis for a medical, eligibility, disciplinary, safety, certification, product-approval, or anti-doping decision.
Varsity Stack does not use your information — including a scanned label image — to train any AI model, and our AI provider may not use information submitted on our behalf to train its general-purpose models. Label extraction on both deployments uses the OpenAI Responses API with store: false on every request and does not use Files, background mode, conversations, web search, or other persistent OpenAI features. OpenAI has approved Zero Data Retention for both label-extraction projects and we have enabled it, under which OpenAI has committed not to store the extracted result after returning it. That is a separate control from store: false, not a restatement of it. Zero Data Retention does not extend to the packaging image itself: our written agreement with OpenAI states that modified retention does not apply to inputs that are images or files, which may be retained by OpenAI as part of its safety screening of submitted content. The image is therefore outside Zero Data Retention by the terms of that agreement, which is why Section 8 limits what you may photograph. This paragraph previously described Zero Data Retention as covering the image; it was corrected on August 9, 2026 to match the agreement.
8. Product Scanning and Confirmation
The Services let you identify a product by scanning its barcode or photographing its supplement packaging. Before upload, the app crops and re-encodes the packaging image and removes EXIF and other embedded metadata. The app sends that processed image through the Varsity Stack backend, never directly to OpenAI, for structured label extraction.
The Varsity Stack backend holds the image only in request memory and discards it as soon as extraction finishes, on the error path as well. Temporary on-device camera and prepared-image cache files are deleted after the result or error. Application code does not write the request body to logs, analytics, or error monitoring, and we deploy the feature only with request-body capture disabled and verified across our hosting, delivery, analytics, and error-monitoring services. We do not retain the raw or processed image. OpenAI may: as described in Section 7, image inputs fall outside Zero Data Retention under our agreement with OpenAI and may be retained as part of its safety screening. Zero Data Retention is approved and enabled on both label-extraction projects and governs the extracted result. You must review and confirm the extracted result before the structured fields — brand, product name, variant, and barcode — may be saved.
The Team Experience scanner follows the same path for a narrower purpose. It sends a cropped, metadata-free packaging image through the Varsity Stack team backend to extract product identity only — brand, product name, variant, and barcode — and does not extract ingredients. The team deployment uses its own separate AI provider project and credentials, held by no other service. The request carries only the processed image and fixed instructions: no athlete name, user or account identifier, school, team, notes, recommendations, or health information reaches OpenAI. The image is not stored by Varsity Stack. The Institution controls the team label scanner, which is off by default for a new team. While it is off, athletes can scan barcodes only and the server rejects any label-scan request from that team.
You are responsible for what you point the camera at. Photograph only supplement packaging. Do not use the scanner to capture a person, documents, identification, medical paperwork, prescription labels, or other information you are not authorized to submit. Product identification and label parsing may be incomplete or incorrect. Certification, prohibited-substance, safety, and approval information comes from third-party registries or authorized staff, not from AI, and Section 9 applies to any certification or ingredient information displayed after a scan.
9. Supplement Certification and Anti-Doping Disclaimer
Varsity Stack may display information from third-party certification programs, product manufacturers, retailers, databases, or anti-doping organizations, including NSF Certified for Sport®, Informed Sport®, BSCG (Banned Substances Control Group), WADA, USADA, the NCAA, professional leagues, or other governing bodies.
Certification and product information may be incomplete, delayed, incorrect, expired, product-specific, formulation-specific, or batch- or lot-specific. A brand having one certified product does not mean that every product, flavor, formulation, batch, or lot from that brand is certified. Varsity Stack does not independently manufacture, test, inspect, certify, approve, or guarantee supplements.
Before using a supplement, you are responsible for:
- reviewing the current product label and ingredients;
- confirming the exact product, formulation, batch, and lot;
- checking current certification databases;
- checking the current prohibited-substance rules applicable to you;
- consulting your team or governing body when appropriate; and
- evaluating possible medication, allergy, contamination, and health risks.
Manufacturing variability, mislabeling, reformulation, contamination, and cross-contamination risks may exist even when a product or related product has been certified.
Under many sport-governing rules, athletes are responsible for substances found in their bodies. Use of Varsity Stack does not transfer that responsibility to Varsity Stack, an Institution, a certification provider, or a retailer. Varsity Stack does not guarantee compliance with NCAA, WADA, USADA, NAIA, professional-league, federation, conference, school, team, or other anti-doping rules.
a. Certification Status Can Change or Be Wrong
Certification information in the Services is a copy of information published by third-party certifiers, taken at a point in time. It is not a live feed and it is not the certifier’s official record. A certifier may add, suspend, withdraw, or let lapse a certification, change the flavors, sizes, or lots it covers, or correct its listing at any time, and the Services may keep showing an earlier status until our copy is refreshed. A product may therefore be shown as certified when it no longer is, or as not certified when it is.
A matching error can also attach a certification to the wrong product. Examples include a similar product name, a different size or flavor, a reformulated product that kept its barcode, and a barcode that was misread or mistyped.
The certifier’s own current listing, checked for the exact product and lot in your hand, is the only authoritative source. A certification badge, a “certified” label, a search result, a filter, a recommendation, a team approval, or a stocked container in the Services is not a representation or warranty by Varsity Stack that the product is certified today. A status that was accurate when a product was added, approved, or stocked may not be accurate later.
Varsity Stack has no duty to notify you or an Institution when a product’s certification status changes, and any notice we choose to send is a courtesy that does not create such a duty. To the fullest extent permitted by law, Varsity Stack is not liable for loss arising from certification information that is inaccurate, incomplete, or out of date.
b. Lot Numbers, Expiry Dates, and Recalls
Where an Institution turns on stock or lot features, the lot numbers, expiry dates, quantities, and records of who holds or was handed which container are entered by people, either Staff or athletes, by typing or by reading a code with the device camera. Varsity Stack does not check these entries against the manufacturer, the certifier, or the physical container.
A lot search matches the lot number as it was entered, ignoring only capitalization and spacing. A lot number entered with a different character, an added or missing hyphen, or a misread digit will not match. A search can therefore miss an affected athlete or container, or return one that is not affected. Any list of similar-looking lot numbers the Services display is a prompt for a person to check, not a finding. A lot record shows which container a person was recorded as holding. It does not show whether anyone consumed the product.
The Services may show a product-level flag taken from a periodic copy of U.S. Food and Drug Administration recall records. That flag is matched by product name or barcode and is not lot-specific. It can be missing, late, or wrong, and its absence does not mean a product has not been recalled. Otherwise the Services do not monitor manufacturer, regulator, or certifier recalls, safety alerts, or lot-specific certification, and they do not send recall notices. Stock and lot features assist an Institution’s own tracing process. They are not a substitute for a recall, adverse-event, chain-of-custody, or inventory-control system, and they must not be the only means used to determine who may have been exposed to a product. Varsity Stack does not notify athletes, including former team members, of a recall. The Services may be unavailable, or a record may be lost, at the moment a recall occurs, so an Institution should keep its own independent copy of the records it depends on. Always compare against the lot number and expiry date printed on the container itself.
10. Accounts and Authentication
You must create an account to use the Services. You agree to:
- provide accurate and current account information;
- maintain the confidentiality of your login credentials;
- use a strong and unique password where passwords are supported;
- not share your account with another person;
- maintain control of devices used to access your account;
- promptly update inaccurate information; and
- promptly notify us of suspected unauthorized access.
You are responsible for activity occurring through your account unless caused by Varsity Stack’s failure to use legally required safeguards. We may require email verification, reauthentication, minimum password strength, or other reasonable security measures. You may not create an account using false information, impersonate another person, or access another person’s account without authorization.
11. Institutional Single Sign-On
An Institution may allow you to access a Team Experience through single sign-on or another institutional authentication provider. By using institutional authentication, you authorize the Institution and authentication provider to provide Varsity Stack with information reasonably necessary to verify your identity, account, affiliation, team membership, and access status.
Where an Institution has enabled single sign-on for its email domain, password sign-in and password reset are disabled for that domain so that the Institution’s own authentication requirements cannot be bypassed. Your access to an institution-managed account may depend on your continued relationship with that Institution, and the Institution may disable institutional authentication or remove access to its Team Experience. Using institutional single sign-on does not give the Institution access to a separate personal account. You are also responsible for following the acceptable-use and security requirements of your Institution and authentication provider.
12. User Information and Content
“User Content” includes information, text, product scans, barcodes, recognized label text, supplement entries, tracking entries, profile and wellness answers, check-in responses, staff-authored notes and recommendations, support messages, feedback, and other content submitted through the Services. You retain ownership of User Content that you lawfully own.
You grant Varsity Stack a limited, nonexclusive, worldwide license to host, store, reproduce, process, transmit, format, and display User Content only as reasonably necessary to:
- provide the Services you request;
- operate authorized Personal and Team Experiences;
- maintain security and prevent misuse;
- provide technical support;
- comply with law; and
- perform the activities described in our Privacy Policy.
This license ends when the applicable User Content is deleted from our active systems, except where continued retention is permitted by the Privacy Policy, required by law, necessary for security or dispute purposes, or maintained in backups awaiting deletion through the normal backup lifecycle.
You represent that you have the necessary rights and authority to provide your User Content. You may not submit:
- another person’s medical, health, education, or identifying information without proper authorization;
- unlawful or fraudulent content;
- content that infringes intellectual-property or privacy rights;
- malware, malicious code, or harmful files;
- false certification or product information;
- content intended to deceive an Institution or another user; or
- information you are prohibited from disclosing under a contract, law, or professional obligation.
Accuracy of entered information. The Services act on information as it is entered. Varsity Stack does not verify information that you, another athlete, Staff, or an Institution enter, scan, select, or confirm, including profile answers, age, weight, doses, product identity, barcodes, lot numbers, expiry dates, approvals, and notes. Recommendations, filters, reminders, adherence figures, lot searches, and team views are only as accurate as the information behind them. The person who enters or confirms information is responsible for its accuracy, and you should promptly correct any error you notice. To the fullest extent permitted by law, Varsity Stack is not responsible for the consequences of information that is wrong, incomplete, out of date, mistyped, attached to the wrong person or product, or never entered.
Tracking, adherence, and streak records show what was logged, not what was actually taken. They are not proof that any person did or did not use a product.
13. Unsupported Regulated Information
The Services are deliberately built without any place to store clinical information. Unless Varsity Stack has entered into an applicable written agreement and has expressly designated a feature for that purpose, you and an Institution may not use the Services — including any free-text field, staff note, recommendation, task, reminder, or product-review note — to submit or process:
- Protected Health Information on behalf of a HIPAA covered entity or business associate;
- medical, clinical, or treatment records;
- diagnoses, prescriptions, or diagnostic records;
- laboratory or blood-work results;
- injury or clinical assessment details;
- insurance, claims, or payer information;
- Social Security numbers or government identification numbers;
- financial-account credentials; or
- other highly sensitive information not requested by the applicable feature.
Free-text fields in the Services are length-limited. A limit is not content validation, and Varsity Stack cannot technically prevent a person from typing excluded information into a box. An Institution is responsible for instructing its staff accordingly. If either party becomes aware that excluded information has been submitted, it should notify the other so it can be removed.
Do not attempt to transform a consumer or data-minimized feature into a regulated clinical workflow without written authorization from Varsity Stack.
14. HIPAA and FERPA
Health-related information is not automatically Protected Health Information under HIPAA merely because it appears in an application. HIPAA applicability depends on the entities, information, relationships, and purposes involved. Unless Varsity Stack has entered into a written Business Associate Agreement and expressly identified the applicable feature as supporting Protected Health Information, the Services are not intended to process Protected Health Information on behalf of a HIPAA covered entity or business associate.
Varsity Stack has signed a Business Associate Agreement with Google Cloud, which hosts the Services. That agreement governs Google’s obligations to Varsity Stack. It is not a Business Associate Agreement between Varsity Stack and you or any Institution, it does not designate any feature for Protected Health Information, and it does not change the restrictions in Section 13.
Information processed at the direction of a school may constitute an education record subject to the Family Educational Rights and Privacy Act or applicable student-privacy laws. When an Institution uses Varsity Stack under an institutional agreement, the Institution is responsible for determining:
- its legal authority to provide or access information;
- whether FERPA, HIPAA, state law, or another requirement applies;
- the appropriate authorized roles;
- whether consent or notice is required;
- whether users have a legitimate educational or institutional interest; and
- its independent retention, access, and disclosure obligations.
These Terms are not a HIPAA Notice of Privacy Practices, FERPA annual notice, medical authorization, or institutional privacy notice.
15. Third-Party Platforms and Sign-In Providers
You may access the Services through an app store, sign in using Apple or Google, or authenticate through an Institution’s provider. Your use of those services is also governed by their terms and privacy practices, and you are responsible for reviewing and managing the permissions you grant them.
Varsity Stack no longer integrates with wearables, Apple Health, HealthKit, Health Connect, or any other health or fitness platform. If you previously connected such a service to Varsity Stack, that integration has been removed and the associated data and access credentials were deleted.
Third-party services may change, restrict, suspend, or discontinue their offerings without notice. Varsity Stack is not responsible for the availability, accuracy, security, or conduct of a third-party service.
16. Privacy and Data Protection
Our Privacy Policy describes:
- the information we collect;
- how information is used and disclosed;
- the separation between the Personal and Team Experiences and their accounts;
- what Institutions may access, and what they can never access;
- our limited uses of AI, for recommendations and label scanning;
- the service providers that host and process information, including where they are located;
- our retention practices;
- consumer health data practices;
- security safeguards; and
- your privacy rights and choices, including data export, analytics opt-out, and account deletion.
The Privacy Policy is incorporated into these Terms by reference. Where legally required, Varsity Stack will obtain affirmative consent before collecting, using, or sharing an additional category of sensitive or consumer health information or using that information for a materially new purpose.
No internet-based service can guarantee absolute security. You must use reasonable care to secure your account and devices.
17. Acceptable Use
You may use the Services only for lawful personal, athletic, educational, or authorized institutional purposes. You may not:
- violate any law, regulation, sport rule, or third-party right;
- access or attempt to access another person’s account;
- bypass authentication, permissions, role restrictions, rate limits, or security controls;
- probe, scan, or test the vulnerability of the Services without written permission;
- introduce malware, harmful code, or automated attacks;
- scrape, crawl, harvest, or extract data without written permission;
- reverse engineer, decompile, disassemble, or attempt to discover source code except where such restriction is prohibited by law;
- copy, sell, sublicense, rent, or commercially exploit the Services;
- use the Services to build a competing dataset, product-certification database, AI model, or service;
- interfere with the operation or security of the Services;
- submit false product, certification, team, or identity information;
- impersonate another person or falsely claim institutional authority;
- use the Services to make unauthorized medical, disciplinary, or eligibility decisions;
- upload another person’s sensitive information without authorization;
- use the Services to harass, threaten, exploit, or harm another person; or
- encourage or facilitate any prohibited conduct.
You may not use automated systems to access the Services unless Varsity Stack has provided written authorization or an official API permitting that access.
18. Intellectual Property
The Services, including their software, source code, databases, product structure, designs, interfaces, graphics, text, trademarks, logos, and branding, are owned by Varsity Stack or its licensors and are protected by intellectual-property laws.
Subject to these Terms, Varsity Stack grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to use the Services for their intended purpose. No ownership rights are transferred to you.
You may not use the Varsity Stack name, logos, product names, screenshots, trademarks, or branding for commercial purposes without written permission. Third-party names, trademarks, certification marks, and logos remain the property of their respective owners. References to third parties do not imply sponsorship, affiliation, approval, or endorsement unless expressly stated.
19. Feedback
If you provide ideas, suggestions, comments, or other feedback about the Services, you grant Varsity Stack a worldwide, perpetual, irrevocable, royalty-free right to use that feedback for any lawful purpose without compensation or attribution. This section does not give Varsity Stack ownership of your private health, fitness, wellness, or team information.
20. Affiliate Links and Third-Party Retailers
Varsity Stack may display links to retailers or participate in affiliate programs. Varsity Stack may earn a commission when you make a purchase through an affiliate link. Affiliate compensation:
- does not guarantee product quality or safety;
- does not affect product-certification rules;
- does not determine an Institution’s review status;
- does not constitute a professional recommendation; and
- does not allow a retailer to receive your health, wellness, or team information from Varsity Stack.
Product prices, availability, shipping, returns, warranties, and transactions are controlled by the retailer. Varsity Stack is not a party to your transaction with a third-party retailer and is not responsible for the retailer’s products, conduct, terms, security, or privacy practices.
21. Beta, Pilot, and Experimental Features
Varsity Stack may provide beta, pilot, early-access, test, or experimental features. These features may be incomplete, contain errors, change without notice, or be discontinued. You understand that beta or pilot features should not be relied upon for medical, emergency, eligibility, compliance, recordkeeping, or other high-risk purposes. An Institution’s participation in a pilot does not guarantee future availability, functionality, pricing, compliance status, or integration support.
22. Service Availability and Updates
We may update the Services automatically or require you to install an updated version. Older versions may stop functioning, may not receive security updates, and may reference features that no longer exist.
We do not guarantee that the Services will be uninterrupted, error-free, secure, or available at all times. Maintenance, outages, third-party failures, security events, legal requirements, and circumstances outside our control may affect availability. We are not responsible for lost access caused by an unsupported device, revoked institutional credentials, lost account credentials, third-party platform failure, or failure to install required updates.
23. Suspension and Termination
You may stop using the Services at any time. You may delete your account from within the app, or request deletion as described in the Privacy Policy; deleting one account does not delete a separate account of the other type. Varsity Stack may restrict, suspend, or terminate access when reasonably necessary to:
- enforce these Terms;
- address suspected fraud, misuse, or unauthorized access;
- protect users, Institutions, Varsity Stack, or third parties;
- investigate a security incident;
- comply with law or legal process;
- prevent harm; or
- discontinue a Service or feature.
Where practical and legally appropriate, we will provide notice before termination. We may act immediately when continued access presents a security, legal, fraud, or safety risk. Sections that by their nature should survive termination will survive, including provisions concerning intellectual property, feedback, disclaimers, assumption of risk, Institution and Staff responsibilities, liability, indemnification, release, disputes, and institutional records.
24. Disclaimer of Warranties

VARSITY STACK DOES NOT WARRANT THAT:
- THE SERVICES WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, OR UNINTERRUPTED;
- ERRORS WILL BE CORRECTED;
- ANY PRODUCT OR CERTIFICATION INFORMATION WILL REMAIN CURRENT;
- ANY CERTIFICATION STATUS, BADGE, OR TEAM APPROVAL SHOWN IS CURRENT OR CORRECT FOR THE PRODUCT OR LOT IN YOUR POSSESSION;
- ANY LOT, EXPIRY, STOCK, OR RECALL RECORD OR SEARCH IS ACCURATE OR COMPLETE;
- INFORMATION ENTERED BY ANY ATHLETE, STAFF MEMBER, OR INSTITUTION IS ACCURATE;
- ANY RECOMMENDATION OR AI-GENERATED EXPLANATION WILL BE CORRECT;
- ANY SCAN WILL CORRECTLY IDENTIFY A PRODUCT OR ITS INGREDIENTS;
- ANY SUPPLEMENT WILL BE SAFE OR EFFECTIVE;
- ANY PRODUCT WILL COMPLY WITH SPORT RULES;
- DATA WILL NEVER BE LOST; OR
- THE SERVICES WILL PRODUCE A PARTICULAR HEALTH, PERFORMANCE, OR INSTITUTIONAL RESULT.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM VARSITY STACK OR THROUGH THE SERVICES CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent permitted by law.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARSITY STACK LLC AND ITS MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES DAMAGES ARISING FROM:
- LOST PROFITS OR REVENUE;
- LOST OR CORRUPTED DATA;
- BUSINESS INTERRUPTION;
- LOSS OF GOODWILL;
- SUPPLEMENT USE;
- PRODUCT CONTAMINATION;
- ADVERSE HEALTH OUTCOMES;
- PERSONAL INJURY;
- ATHLETIC PERFORMANCE;
- ANTI-DOPING VIOLATIONS;
- LOSS OF ELIGIBILITY;
- INSTITUTIONAL DECISIONS;
- RECOMMENDATIONS OR AI-GENERATED CONTENT;
- THIRD-PARTY PRODUCTS OR SERVICES; OR
- UNAUTHORIZED ACCESS TO THE EXTENT NOT CAUSED BY VARSITY STACK’S VIOLATION OF APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARSITY STACK IS ALSO NOT LIABLE FOR LOSS TO THE EXTENT IT IS CAUSED BY:
- CERTIFICATION INFORMATION THAT A CERTIFIER CHANGED, WITHDREW, OR LET LAPSE, OR THAT IS OTHERWISE INACCURATE OR OUT OF DATE;
- LOT, EXPIRY, STOCK, OR RECALL RECORDS OR SEARCHES, INCLUDING A MISSED OR MISTAKEN MATCH;
- INFORMATION ENTERED, SCANNED, OR CONFIRMED INCORRECTLY, OR NOT ENTERED, BY YOU, ANOTHER ATHLETE, STAFF, OR AN INSTITUTION;
- THE ACTS OR OMISSIONS OF AN INSTITUTION OR ITS STAFF; OR
- A PRODUCT MADE, CERTIFIED, OR SOLD BY A THIRD PARTY.
THE ATHLETE APPLICATION IS PROVIDED FREE OF CHARGE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARSITY STACK’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (1) THE AMOUNT YOU PAID DIRECTLY TO VARSITY STACK FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (2) ONE HUNDRED U.S. DOLLARS. THIS SECTION DOES NOT LIMIT THE OBLIGATIONS VARSITY STACK OWES AN INSTITUTION UNDER A SEPARATE WRITTEN AGREEMENT.
These limitations apply regardless of the legal theory, even if Varsity Stack was advised that damages were possible, and even if a remedy fails of its essential purpose. The cap is a single aggregate limit; more than one claim does not enlarge it. The athlete application is offered free of charge in reliance on these disclaimers and limits, which are an essential basis of the bargain between you and Varsity Stack. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, willful misconduct, or gross negligence, liability for personal injury caused by Varsity Stack’s own negligence, and any statutory right that cannot be waived, in each case where applicable law prohibits the limitation.
26. Indemnification and Release
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Varsity Stack LLC and its members, officers, directors, employees, contractors, affiliates, and licensors from third-party claims, damages, judgments, losses, liabilities, and reasonable legal expenses arising from:
- your unlawful or unauthorized use of the Services;
- your material violation of these Terms;
- User Content you were not authorized to provide, including information submitted contrary to Section 13;
- your infringement of another person’s rights;
- your attempt to access another person’s account or information;
- your misuse of supplement, certification, or recommendation information; or
- your violation of applicable law.
If you use the Services on behalf of an Institution, then to the extent permitted by the law that applies to the Institution, and unless a separate written agreement with Varsity Stack provides otherwise, the Institution will defend, indemnify, and hold harmless the same parties from third-party claims arising from the matters for which Section 4(g) makes the Institution responsible, including its Staff’s decisions, entries, and omissions. Where that law does not allow the Institution to indemnify, the Institution remains responsible for those matters as between it and Varsity Stack. Sections 28 and 29 apply to an Institution only to the extent its governing law permits.
This section does not require you or an Institution to indemnify Varsity Stack for Varsity Stack’s own unlawful conduct.
Release. Varsity Stack does not make, test, certify, sell, stock, or hand out supplements, and does not control Institutions, Staff, manufacturers, certifiers, retailers, or other users. To the fullest extent permitted by law, you release Varsity Stack LLC and its members, officers, directors, employees, contractors, affiliates, and licensors from claims and damages to the extent they are caused by the acts or omissions of any of those third parties, including a product’s contents, a certifier’s listing, a retailer’s sale, and an Institution’s or its Staff’s decisions and entries. If you are a California resident, you waive California Civil Code Section 1542, which says: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.” This release does not cover claims for Varsity Stack’s own acts or omissions, or claims that cannot be released under applicable law.
27. Informal Dispute Resolution
Before starting arbitration or filing a lawsuit, the party raising a dispute must send the other party a written notice describing:
- the party’s name and contact information;
- the relevant account information;
- the facts giving rise to the dispute;
- the legal claims;
- the requested relief; and
- a good-faith calculation of any requested monetary amount.
Notices to Varsity Stack must be sent to support@varsitystack.com with the subject line “Legal Dispute Notice” or by mail to the address listed in the Contact Us section below. The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice. Any limitations period and any filing deadline for the claims described in the notice is paused during those 30 days. This requirement does not prevent either party from seeking immediate relief where necessary to prevent imminent harm, protect intellectual property, or preserve a legal claim before a limitations period expires.
28. Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
a. Agreement to Arbitrate
Except for the claims identified below, any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, the Services, your account, or your relationship with Varsity Stack will be resolved through final and binding individual arbitration rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
The arbitrator, and not a court, has exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration agreement, except that a court will decide whether the class-action waiver in subsection (d) is enforceable. This arbitration agreement survives the end of your account and of these Terms.
b. Arbitration Administrator and Rules
Arbitration will be administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, as modified by these Terms. The arbitration may occur by telephone, video conference, written submissions, or in person, as permitted by the applicable rules and determined by the arbitrator. Varsity Stack will pay arbitration fees to the extent required by the applicable rules or law. Each party remains responsible for its own attorneys’ fees unless the arbitrator awards fees under applicable law.
c. Exceptions
Either party may:
- bring an individual claim in a court of competent jurisdiction that qualifies as small claims court;
- seek temporary or emergency injunctive relief to prevent unauthorized access, security threats, misuse, or intellectual-property infringement; or
- bring a claim that applicable law does not permit to be arbitrated.
d. Individual Proceedings Only
YOU AND VARSITY STACK AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY. Neither party may participate as a plaintiff, claimant, or class member in a class action, representative action, collective action, consolidated action, or class-wide arbitration. The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.
e. Jury-Trial Waiver
To the extent a dispute proceeds in court rather than arbitration, you and Varsity Stack knowingly and voluntarily waive any right to a jury trial, except where such waiver is prohibited by law.
f. Opting Out of Arbitration
You may opt out of this arbitration agreement by sending written notice to support@varsitystack.com within 30 days after you first accept these Terms. Your notice must include your name, account email address, and a clear statement that you are opting out of the Varsity Stack arbitration agreement. Opting out of arbitration will not affect the remaining Terms or your ability to use the Services.
g. Arbitration Severability
If the class-action waiver is found unenforceable for a particular claim or requested remedy, that claim or remedy will proceed in court after all arbitrable claims are completed. The same applies to a request for public injunctive relief that applicable law does not allow to be arbitrated. If another part of this arbitration section is found unenforceable, the remaining portion will remain in effect to the fullest extent permitted by law.
29. Governing Law and Court Venue
Except as governed by the Federal Arbitration Act or another controlling law, these Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law rules. For disputes that are not subject to arbitration, the parties consent to the exclusive jurisdiction of the state and federal courts located in South Carolina, except where applicable consumer law requires another venue.
30. Changes to These Terms
We may update these Terms to reflect changes in:
- the Services;
- our business;
- applicable law;
- security requirements;
- institutional features; or
- third-party platforms.
We will post the updated Terms with a revised “Last Updated” date. For material changes, we may provide additional notice through the Services, by email, or through another reasonable method. We will request renewed acceptance when required by law.
Unless otherwise stated, updated Terms apply prospectively after their effective date. Changes to the arbitration provisions will not apply to a dispute for which a valid written dispute notice was received before the change unless the parties agree otherwise. Your continued use after updated Terms take effect constitutes acceptance where permitted by law.
31. Apple App Store Terms
This section applies when you download or use the application through Apple’s App Store. These Terms are between you and Varsity Stack, not Apple. Varsity Stack, not Apple, is solely responsible for the application and its content, subject to these Terms.
Varsity Stack grants you a nontransferable license to use the application on Apple-branded products that you own or control and as permitted by the applicable App Store Usage Rules, including permitted Family Sharing arrangements.
Apple has no obligation to provide maintenance or support services for the application. If the application fails to conform to an applicable warranty that cannot legally be disclaimed, you may notify Apple, and Apple may refund the purchase price, if any. The application is provided free of charge. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the application.
Varsity Stack, not Apple, is responsible for addressing claims relating to the application, including product-liability, legal or regulatory, privacy, consumer-protection, and intellectual-property claims.
You represent that you are not located in a region subject to a U.S. government embargo or designated by the U.S. government as supporting terrorism and that you are not listed on a U.S. government prohibited- or restricted-party list. You must comply with applicable third-party terms when using the application. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.
32. Google Play and Other Platforms
If you download the Services through Google Play or another platform, your use is also subject to that platform’s applicable terms. To the extent these Terms conflict with mandatory platform terms concerning licensing or platform-specific consumer rights, the applicable mandatory platform terms will control for that limited purpose. Varsity Stack, rather than the platform provider, is responsible for providing support concerning the Services unless the platform’s terms state otherwise.
33. General Legal Terms
a. Entire Agreement
These Terms, the Privacy Policy, applicable Team Participation and Data-Sharing Notices, and any additional terms expressly presented for a particular feature constitute the agreement between you and Varsity Stack regarding your use of the Services.
b. Order of Precedence
If documents conflict, the following order applies for the subject of the conflict:
- an applicable institutional agreement, solely regarding the Institution’s and Varsity Stack’s contractual responsibilities;
- a feature-specific consent or Team Participation and Data-Sharing Notice, solely regarding the relevant collection or disclosure;
- the Privacy Policy, regarding privacy and data-processing practices; and
- these Terms.
c. Severability
If any provision is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain effective.
d. No Waiver
Failure to enforce a provision is not a waiver of the right to enforce it later.
e. Assignment
You may not assign or transfer these Terms or your account without written permission. Varsity Stack may assign these Terms as part of a merger, financing, acquisition, corporate reorganization, sale of assets, or transfer of the Services, subject to applicable law and the Privacy Policy.
f. No Agency
These Terms do not create an employment, partnership, joint venture, fiduciary, medical-provider, or agency relationship between you and Varsity Stack.
g. Force Majeure
Varsity Stack will not be responsible for delay or failure caused by events reasonably beyond its control, including natural disasters, severe weather, war, terrorism, labor disputes, internet or cloud outages, government actions, epidemics, infrastructure failures, or third-party platform disruptions.
h. Electronic Communications
You consent to receive agreements, disclosures, notices, and other service-related communications electronically. You may withdraw consent where permitted by law, but doing so may prevent us from providing features that require electronic communication.
i. Headings
Section headings are for convenience and do not affect interpretation.
j. No Third-Party Beneficiaries
Except as stated in Section 31 and for the parties named in Sections 25 and 26, these Terms give no rights to anyone other than you and Varsity Stack.
k. Notice for California Users
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
